Short Title
The Criminal Code Act (2017)
Description
An Act to establish a Criminal Code for Londinium.
Definitions
1. Criminal Code - Defines the crime, crime severity and the punishment for a committed crime. The Royal Courts of Londinium shall oversee trials and use punishment fitting for the crime committed within the constraint of this criminal code.
2. Misdemeanor- A lesser crime of lower severity that is punishable by no less than a verbal reprimand for offenders, a temporary ban of no less than 1 day or no more than 4 days for repeat offenders.
a. Should an individual commit 2 Misdemeanors within two months, the Royal Courts may escalate the offence to a high severity crime.
3. Felony- Dangerous and criminal offences that can affect the life and reputation of a person, the national security of Londinium, or the sanctity and image of the Londinium. Felonies may warrant penalties from 3 days temporary to a life banishment from the region.
Article I - Rights and Clarifications
1. The Royal Court of Londinium shall retain the right to impose a ban in the case of convictions of high severity crimes and felonies. (Temporary or Life banishment)
2. The Royal Court of Londinium may combine punishment for multiple crimes.
3. Offences committed while following the mandate of the law shall be punishable by the The Royal Court.
4. Accessory to crime shall merit punishment and the degree of crime shall be determined by the ruling of the Royal Court. Two or more felonies particularly in the case of treasonable feloneous offences and threats to the national security of Londinium may warrant equal punishment.
5. No citizen may face double jeopordy and be tried twice for the same offence.
6. The Royal Court may, with reason, rule extra punishment that does not extend the severity or length of the standard punishment for a crime such as, but not limited to, community service, public apology, or probation for good behaviour.
7. Violation of Zetaboard's Terms of Service and Terms of Use may fall under the discretion of the Monarch and he/she may hand down any punishment deemed fit but only based on the strict words therein.
8. A citizen that unwillingly commits a crime shall not be given a high severity punishment unless such crime has been specified.
9. This Code extends to all areas of Londinium. RMB, all forum areas and chat service up to and including Discord etc..
Article II - Severity Of Crime
1. Low severity offences are Misdemeanours. Crimes committed out of ignorance and/or negligence can be deemed minor felonies.
a. Low severity crimes may be punished through a warning with either a 1 day temporary ban or a 4 day ban .
b. Crimes that may fit low severity are: Breaches of Peace , Defamation,
Discrimination, False Accusation, Harassment, Libel .
2. High severity offences are Midemeanorscommitted 2 times within two month and Felonies usually committed either in conspiracy or with the full knowledge of the crime's severity
a. High severity crimes are punishable with a ban from 3 days ban to a Life Ban, and the permanent stripping of titles (Noble, Royal and other titles).
b. Crimes that are deemed high severity include: Conspiracy, Assault, Breach of Zetaboards Terms of Service, Hacking , Impersonation, Terrorism, Treason, a Misdemeanor committed 5 times within a two month period, Discrimination committed twice or more,and Perjury.
Article III - Conspiracy
1. A person is guilty of conspiracy to commit an offence when he knowingly agrees to engage in any conduct that he/she knows would aid in the conduct of such offence or crime.
2. A person is guilty of of the conspiracy to commit treason when he/she was aware of an ongoing conspiracy to commit treason and he/she failed to inform the Monarch, Prime Minister, Lord Chancellor or other members of government.
3. A person is guilty of attempting a crime when he/she has knowingly taken a substantial step furthering the offence in question.
4. Penalties for conspiracy and attempting a crime shall be administered through a Royal Court ruling.
5. Conspiracy and attempting a crime are punishable with two week ban and removal of titles from any title holder found guilty of the conspiracy and attempting a crime.
Article IV - Misdemeanours
1. The Following Sub-Sections will be what constituents Misdemeanours.
a. Disruptive Behavior: Recruiting, Advertising or Spamming on the Regional Message Board or the forum of Londinium without consent of the Sovereign or Prime Minister.
b. Trolling: Purposeful eliciting a negative emotional reaction from users, frustration of users, and/or social discord. An action may be considered Trolling where such an action is designed to cause severe negative emotional reaction from users, frustration of users, and/or social discord should such consequences have been reasonably predictable.
c. Fraud: is defined as any attempt to provide maliciously false or maliciously misleading information to a Government Official.
d. Exceeding the endorsement cap: The purposeful transgression of the endorsement cap is forbidden, if the Sovereign does not give his or her consent; failure to remedy accidental transgression of the endorsement cap within twenty-four hours of being made aware of the transgression shall make retention of any such endorsements purposeful, and thereafter punishable as a purposeful transgression.
e. Unlawful Posting: is defined as posting in any governmental area in which one is not authorized by the relevant government official(s) to post or excessive, out of context posting on the Regional Message Board or in any area of the regional off-site property that is not designated for that purpose.
f. Harassment: Any action which is by design insulting, badgering, or pressuring of players on the forum or RMB in spite of petition(s) to cease and desist. Insult shall be considered purposeful if not intentional where insult as a consequence of any action is reasonably predictable.
g. Vexatious Litigation: Abusing the judicial process through repetitive or frivolous reports/accusations.
h. Unlawful Discrimination: Discriminating against a person on grounds of that person's race, color, national or ethnic origin, religious belief, sexuality, asexuality, gender or agender identity or expression, sex, sex characteristics or disability by not dealing with that person under the terms and conditions normally applied with other persons.
2. The maximum sentence for all misdemeanours in Article 3 Section 1 Sub-Sections a through f shall be no greater than 10 days banishment from the in-game region and offsite forum.
3. The maximum sentence for all misdemeanours in Article 3 Section 1 Sub-Section g through h shallbeno greater than 1 month banishment from the in-game region and offsite forum.
Article V - Felonies
1. The Following Sub-Sections will be what constituents Major Offenses.
A. Perjury: Falsely testifying to deceive to a court of law.
B. Desertment: Refusing to assist in the defense of Londinium against invasion.
C. Repeat Violation: Should a player be found guilty of a crime against the Public on multiple occasions, and should that player seem as though they are not learning their lesson, a user may be tried for repeatedly offending the law.
D. Forum Crimes: Destroying forum content in a destructive way, pornspamming, gorespamming, and other such things that break Zetaboard Terms of Service.
E. Impersonation: Claiming to be another player, or claiming to represent Londinium and/or having official associations with Londinium without this being a factual claim.
F. Personal Crimes: If sensitive real-life information or personal information about users are posted without their consent, and the relevant person decided to sue the offender.
G. Deception: An individual is guilty of Deception if they have a nation or forum account that is being used to circumvent or evade a Judicially imposed ban for a previous offense.
H. Espionage: Gathering private and/or sensitive government information to be used or distributed against the interests of Londinium and/or without permission or leaking content from private forums or chats to third persons without the consent of the Sovereign or Prime Minister.
I. Subversion: Conspiring against the interests of Londinium, such as deliberately trying to lower the endorsement count of the legal delegate and calling for actions against officials of the region or the region unless otherwise prescribed by law, or assisting in and/or not reporting such subversive activities.
1. The maximum sentence for all felonies in Article 4 Section 1 Sub-Sections a through g shall be no greater than 12 months banishment from the in-game region and offsite forum.
2. The maximum sentence for all felonies in Article 4 Sections h through i shall be no greater than 18 months banishment from the in-game region and offsite forum, and/or removal of citizenship or Immigrant Status.
Article VI - Highest Offences
1. The Following Sub-Sections will be what constituents the Highest Offenses.
a. Anti-Governmental Activity: Intending to cause internal discord or political division for the purpose of sabotage of the region and its government; or intending to impede daily government activities and duties for the purpose of sabotage. This charge may also be used in place of charges of subversion and espionage.
b. Forum Destruction: Abusing administrative powers on a forum to cause a denial of service or substantial loss of information.
c. Treason: Giving aid to enemies of the region; participating in or inciting war against Londinium; or seizure, attempted seizure, or inciting others to seize a position unlawfully. Any aid or comfort to an enemy.
2. The minimum sentence for all highest offenses as defined in Article 3 Section 1 Sub-Sections a through c is no less than 6 months banishment from the in-game region and forum, and the maximum sentence for all highest offenses as defined in Article 3 Section 1 Sub-Sections a through c is indefinite banishment from the in-game region and forum.
Article VII - Statues of Limitations
1. Should a highest offense case not be submitted to the Royal Court within 1 year of the offense allegedly occurring, the case must be dropped.
2. Should a felony case not be submitted to the Royal Court within 6 months of the offense allegedly occurring, the case must be dropped.
3. Should a misdemeanour case not be submitted to the Royal Court within 1 month of the offense allegedly occurring, the case must be dropped.
