Attorney General Act (2017)
An Act to establish the Office of the Attorney General and lay out powers here in.
Short Title
(1) This Act may be cited as the Attorney General Act (2017).
Office of the Attorney General
(2) The Office of the Attorney General ("The Office") is hereby established and powers enacted and a Forum entitled "Office of the Attorney General" established.
(3) The Prime Minister shall appoint an individual to the Office at the commencement of every term, or if the Office is vacant.
(4) The Office shall be declared vacant if the Attorney General:
a. resigns;
b. is impeached by a 2/3 majority vote in all legislative Houses;
c. is removed from the Office by the Royal Court as a sentence for an offence; or
d. is dismissed by the Prime Minister.
Qualifications of the Attorney General
(7) The Attorney General may not hold: the Office of the Prime Minister ; any position in the Judiciary; or any position in the Royal Family.
Responsibilities of the Attorney General
(8) The Attorney General shall be the default state prosecutor for criminal cases in Londinium and may represent the region in the instance of a Judicial Review and may from time to time submit Friend of the Court brief in cases of interest.
(9) The Attorney General shall be the primary legal adviser to the Prime Minister, Cabinet and Monarch.
(10) Notwithstanding executive actions the Attorney General may regulate the Office as they see fit and may appointment and dismiss Deputies freely.
(11) Deputies may represent the Region as prosecutors before the Courts with the Attorney Generals permission; only the Attorney General can decide to prosecute a Criminal matter.
Conflict of Interest
(12) Should a conflict of interest exist, the presiding Justice shall appoint an alternate prosecutor.
(13) The defendant in a criminal case may petition the presiding Justice to determine whether a conflict of interest exists. On receiving such a petition, the presiding Justice shall be obligated to investigate whether such a conflict of interest exists.
(14) In the event that the Attorney General is the subject of a criminal case, the presiding Justice must appoint an alternate prosecutor
